Copyright and Abuse Complaints
How to send us a copyright notice or counter-notice, our handling process and timelines, our repeat-infringer termination policy, and our designated agent.
1. Our role in the chain
TP VPN is an encrypted transit service. We do not host, store, index or cache user content — traffic is forwarded through our nodes and no copy remains on them. Under the U.S. Digital Millennium Copyright Act this is "transitory digital network communications" under §512(a), not "storage at the direction of a user" under §512(c).
By contrast, content we host ourselves — this website, our assets, our downloads — is fully within our control. Notices about that material are handled through the standard notice-and-takedown process.
2. Filing a copyright notice
Send a written notice to the designated agent below. It must contain all six elements required by DMCA §512(c)(3):
- A physical or electronic signature of the rights holder or an authorised agent.
- Identification of the copyrighted work claimed to have been infringed; a representative list is acceptable if one notice covers multiple works.
- Identification of the material claimed to be infringing, with enough information for us to locate it. For VPN transit, please always include: our egress IP address, a precise timestamp with time zone (seconds if possible), and the protocol and port if known.
- Your contact information: address, telephone number and email address.
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information is accurate and, under penalty of perjury, that you are authorised to act on behalf of the rights holder.
3. Our handling process and timelines
| Step | Action | Timeline |
|---|---|---|
| 1 | Log the notice, acknowledge receipt, assign a case number | Within 3 business days |
| 2 | Formal review: are all six elements present? If not, we say in one reply what is missing | Within 3 business days |
| 3 | If it concerns content we host: remove or disable access | Within 2 business days of a complete notice |
| 4 | If it concerns VPN transit: attempt attribution by egress IP plus timestamp. Where attribution succeeds, we forward the notice to that user and act under the AUP | Within 5 business days |
| 5 | Where attribution fails: we explain why in writing. Repeated notices against the same egress lead to action at the node or route level | Same |
| 6 | The record counts towards that account's repeat-infringer tally (see §5) | Immediately |
We do not terminate an account on a single unverified notice. Nor do we disclose a user's identity to a complainant except under valid legal process (a court order or a §512(h) subpoena).
4. Counter-notice
If your material was removed or access disabled and you believe that was a mistake or misidentification, you may file a counter-notice containing:
- Your physical or electronic signature.
- Identification of the removed material and where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, plus consent to jurisdiction of the federal district court for your district (or, if you are outside the United States, for the district in which we are located), and consent to accept service from the complainant or their agent.
On receiving a compliant counter-notice we forward it to the original complainant. If they do not tell us within 10 business days that they have filed an action, we will normally restore the material or re-enable access in 10 to 14 business days.
5. Repeat infringer policy
As required by DMCA §512(i), we have adopted and reasonably implement the following policy:
- First verified and attributable notice: the notice is forwarded to the user with a formal warning.
- Second: the account is suspended and restored only after the user confirms in writing that the conduct has stopped.
- Third: the account is terminated, the remaining balance is not refunded, and we do not open a new account for that user.
- The counting window is 12 rolling months. Records overturned by a successful counter-notice, or found unsubstantiated on our own review, do not count.
- Where there is clear evidence of bad faith or large-scale commercial infringement, we may terminate without going through the stages above.
6. Designated agent
Agent designated to receive notifications of claimed infringement under DMCA §512(c)(2):

7. Consequences of a false notice
Under DMCA §512(f), anyone who knowingly materially misrepresents in a notice or counter-notice is liable for the resulting damages, including attorneys' fees. We keep records of notices that are plainly unfounded, sent by automated bulk systems, or intended to harass, and reserve the right to decline to act on them and to pursue remedies.
8. Non-copyright complaints and legal requests
- Network abuse (spam, scanning, DDoS, malware): email abuse@tpvpn.com; the process is in AUP §5–6.
- Trademark, defamation, privacy and other claims: email legal@tpvpn.com with proof of right and the specific claim.
- Child sexual exploitation material: email abuse@tpvpn.com with CSAM in the subject; prioritised, see AUP §3.
- Law enforcement data requests: email legal@tpvpn.com. We respond only to legal process served in our jurisdiction of incorporation and valid in form and substance; cross-border requests should come through mutual legal assistance channels. Our review and notice principles are in Privacy Policy §13.
- Emergencies involving an imminent risk of death or serious physical injury: put EMERGENCY in the subject line. We prioritise these and respond to the extent applicable law allows.
