End User Licence Agreement
This agreement sets the licence terms for installing and using the TP VPN client software. It is between you and us — Apple and Google are not parties to it.
1. Who this agreement is with
This End User Licence Agreement (the "Licence") is concluded between you and TP VPN LLC. Apple Inc., Google LLC and their respective affiliates are not parties to this Licence and bear no responsibility for the client software itself. You and we both acknowledge that this Licence is between us alone and not with Apple or Google.
This Licence covers the software only. The Service itself — accounts, subscriptions, the node network — is governed by the Terms of Service and Privacy Policy. Where they conflict on a software-licensing question, this Licence prevails.
2. Scope of the licence
We grant you a non-exclusive, non-transferable, revocable licence to install and use the client software on devices you own or control, for personal, non-commercial use (Enterprise use is governed by contract).
- On Apple platforms, this licence is subject to the Usage Rules in the Apple Media Services Terms and may be accessed by other accounts through Family Sharing or volume purchasing, where applicable.
- You may not: distribute or make the software available over a network for simultaneous use by others; rent, lease, lend, sell, sublicense or transfer it; reverse engineer, decompile, disassemble or attempt to derive the source code (except where applicable law expressly prohibits that restriction); or remove or obscure any proprietary notice.
- You may not modify the software or create derivative works, nor embed it in another product offered to third parties.
- Updates and upgrades are covered by this Licence unless a separate agreement accompanies them.
The software includes open source components. For those components, their own licences take precedence over any conflicting restriction here. The full list is in the app under About → Open Source Licences.
3. Maintenance and support
Maintenance and technical support for the software are provided solely by us. Contact support@tpvpn.com or visit our support page. Apple and Google have no obligation whatsoever to furnish any maintenance or support services for the client software.
4. Warranty
To the maximum extent permitted by law, the software is provided "as is", without warranty of any kind, express or implied.
If the software fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the software (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the software. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
If you are a consumer, this section does not reduce your statutory rights under the mandatory law where you live.
5. Product claims
We — not Apple or Google — are responsible for addressing any claim by you or a third party relating to the client software or your possession and use of it, including but not limited to: (a) product liability claims; (b) any claim that the software fails to conform to an applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.
6. Intellectual property claims
If a third party claims that the client software, or your possession and use of it, infringes that party's intellectual property rights, we — not Apple or Google — are solely responsible for the investigation, defence, settlement and discharge of that claim.
7. Legal compliance
You represent and warrant that: (i) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; (ii) you are not listed on any U.S. Government list of prohibited or restricted parties; and (iii) you will comply with all local laws applicable to your use of the software, including restrictions on the use of encryption tools.
